LITIGATION DEPARTMENT ACHIEVES TWO APPELLATE WINS FOR THEIR CLIENTS

Senior Partner John Jopling successfully preserved two recent trial court victories for the firm’s clients, by obtaining per curiam affirmed decisions from the Fifth District Court of Appeal and First District Court of Appeal. The decision from the 5th DCA, in late July, affirmed a summary judgment obtained by Dell Salter for their client, a horse park from which another defendant’s horse had escaped, resulting in a collision with a motor vehicle. The summary judgment and per curiam affirmance confirmed that the responsibility for the animal’s escape lay exclusively with the animal’s owner and not with the owner of the property from which it escaped.

On October 1, following oral argument, the First District Court of Appeal issued its per curiam affirmance of a dismissal with prejudice obtained by the Dell Salter litigation department on behalf of physicians sued for alleged delayed diagnosis. The appellate decision affirmed the trial court’s ruling that the action against the physicians was barred by the medical malpractice statute of repose.
