“Stand Your Ground” Defense Applied To School Bus Fight Case


The “Stand Your Ground” defense, so much in the news lately as a result of the Zimmerman trial, has been applied recently to a case involving children on a school bus.

Two children were fighting on a school bus, with the girl starting the fight.   The boy retaliated, and got arrested.   The Court refused to apply the defense to dismiss the charges against the boy.   This decision was reversed on appeal by the Fourth District Court of Appeals on July 17.   The Court held that the “Stand Your Ground” defense was applicable, and the charges against the boy should have been dismissed.
