The jury needed less than 25 minutes to determine that Kevin’s client did not breach its contract of insurance with the Plaintiff. The jury disagreed that State Farm should have paid for property damage to the transmission of the Plaintiff’s truck which was allegedly caused by a motor vehicle accident. The Plaintiff and Kevin each presented testimony from multiple lay witnesses and expert witnesses during the course of the trial. State Farm would have been subject to a claim for attorney fees and costs in excess of $100,0000 if the jury had awarded the Plaintiff $1.00 or more. As a result of the defense verdict, State Farm has the option of pursuing its attorney fees and costs based upon a proposal for settlement that was not accepted by the Plaintiff and the Florida statute regarding the prevailing party at trial.
