Dell Graham Represents Alachua County School Board Before Florida Supreme Court

In April, Dell Graham’s appellate law division succeeded before the Florida Supreme Court on behalf of the School Board of Alachua County. In a unanimous order, all seven Justices agreed with Dell Graham’s appellate arguments regarding lack of jurisdiction. The Court concluded that although jurisdiction was initially accepted to review the First District Court of Appeal’s decision affirming the trial court’s order for the School Board, such “jurisdiction was improvidently granted.” As a result, the Florida Supreme Court dismissed the appeal. An appellate attorney wrote the briefs and pleadings submitted to the Florida Supreme Court and David M. Delaney presented oral argument in February. (briefs). Dell Graham represented the School Board in this case at the trial court, before the First DCA, and before the Florida Supreme Court. Each court ruled in favor of the School Board, and the Florida Supreme Court will not entertain any additional motion for rehearing.[learn more about David M. Delaney]
