David Delaney successfully defended a Florida public school district against a lawsuit brought by a student injured during a varsity basketball game. The player acknowledged during his deposition that he and his mother had signed the release of liability provided by the Florida High School Athletics Association prior to the start of the season. Mr. Delaney was therefore able to quickly bring the matter before the court for a final ruling. Although the Florida Supreme Court has recently disfavored releases for minors, those cases have involved private commercial enterprises rather than public or not for profit entities. Therefore, the Court determined that there were no issues of fact to be decided at trial and gave the School District a complete dismissal.
